Who Will Take Next Action to Curb Costs of E-Discovery? Congress or Rules Committee?

In an article recapping the hearing before a House Judiciary panel on the growing costs of discovery, Eileen Malloy cites Rebecca Love Kourlis' testimony several times, including:

“Civil jury trials have all but vanished,” Kourlis added. The civil justice system of the United States is too expensive and too complicated. Cases frequently settle due to costs and not merits. Access to jury trials must be maintained. Jurors infuse common sense and are another check and balance, she said.
