Businesses today face a range of challenges and needs in resolving legal disputes, which can vary depending on the size and nature of the business, the complexity of the dispute, and the desired outcome. While traditional litigation in state and federal courts is an option, there is a growing recognition that a “one-size-fits-all” approach may not be the most effective way to resolve all business disputes. Research points to the importance of tailored processes and pathways—such as business courts, complex dockets, and alternative dispute resolution (ARD)—to meet the unique business needs of companies of all sizes and to provide timely case management and disposition.
To help chart a better future for resolving business disputes, IAALS brought together business leaders, attorneys representing businesses, judges and court administrators, and other thought leaders and practitioners to discuss the landscape of businesses’ justice needs and to craft new ways of meeting them.
The convening covered the justice challenges for businesses, promising models and best practices, and key takeaways from existing business dispute resolution pathways. The ideas and solutions generated through this convening will spur innovative new models for businesses to more effectively and efficiently meet their legal needs, and will inform the development of recommendations for improving the overall dispute resolution process for businesses of all sizes.
