This week, IAALS Executive Director Rebecca Love Kourlis penned an article for the ABA Journal’s The New Normal, which focuses on how the litigation process is being remade. Kourlis walks down the road that reforms in the civil justice system have taken so far, in an effort to make the civil justice system more accessible, less costly, less time-consuming, and more responsive to the needs of the public.

Despite an earlier agreement to move forward with Senate confirmation of judicial nominees, Senator Al Franken and others report that the process remains acrimonious. Nearly one in 10 seats on the federal bench are currently empty.

In May, the National Center for Access to Justice published the latest iteration of the Justice Index, a national survey of state civil justice policies. Based on an examination of policies across four civil justice areas—attorney access, support for self-represented litigants, language access, and disability access—the index assigns a score to each state.

Public opinion polls consistently show that voters know very little about judges and judicial candidates on the ballot and wish they had more information. Around the country, judicial branch entities, state bar associations, and other groups are working to change that. In the November judicial elections, voters in many states will have the benefit of objective assessments of the performance of incumbent judges, and in some instances, the qualifications of their challengers.

At a recent campaign appearance, Justice Barbara Pariente cautioned that a November vote not to retain her and two fellow justices who are also on the ballot would allow Governor Scott to make "partisan judicial appointments."

Lawmakers in California recently spoke out against the state bar's exploration of regulatory reform as a means to address the access-to-justice crisis. However, the need for efficient and affordable legal services is growing exponentially—and data suggests that legal services innovation could a key part of the solution.

In May, IAALS hosted the Udall-Bennet Federal Judicial Screening Committee, which was charged with interviewing applicants for an upcoming vacancy on the U.S. District Court for the District of Colorado and recommending highly qualified candidates to the senators. IAALS Executive Director Rebecca Love Kourlis and Denver attorney Hal Haddon served as co-chairs of the bipartisan, 11-member advisory committee.

IAALS submitted this comment to the Colorado Supreme Court in support of the Colorado Licensed Legal Paraprofessionals Program. The program would authorize paraprofessionals to provide limited legal services in family law without attorney supervision.

In a recent blog post, Richard Zorza shares some thoughts on improving services for self-represented litigants in the United States. He believes that the legal system needs an aspirational goal to address access to justice, which can ultimately move the system in the direction of meaningful change.

Three Democratic senators asked Chief Justice Stuart Rabner to investigate allegations that a Republican legislator pressured superior court judges regarding a judicial nomination. According to the senators, the Republican lawmaker told two judges facing re-nomination that the governor would “end their judicial careers” if they did not persuade Democrats to sign off on the governor’s nominee.
