Over the past 10 years, courts and commentators have struggled with this issue. Some, such as the American College of Trial Lawyers, have proposed radical limits on discovery to essentially take the problem of e-discovery off the table. But if the new technology in fact helps control the spiraling e-discovery costs as expected, then the pressure for radical rule changes may be lessened, at least insofar as such changes would be addressed to controlling the cost of review.
