Last year, IAALS surveyed members of the American Board of Trial Advocates about their trust and confidence in the legal system and factors that influence their perspectives. A substantial majority of respondents reported high levels of confidence in both the state and federal court systems, but others gave us reasons for their declining confidence.

In 2018, the NCBE created its Testing Task Force to conduct a three-year project that, in part, examines whether the bar exam is a valid measure of minimum competence to practice law. Last month, NCBE released a report detailing the findings of Phase 2, a national practice analysis, which will provide a foundation of data for bar exam reform.

On April 7, the ABA Board of Governors approved a resolution urging state licensing authorities to immediately adopt emergency rules that would authorize recent law school graduates to practice law without passing a bar exam, in light of the COVID-19 pandemic.

In a new white paper published on March 22, 11 legal scholars stress the need for jurisdictions to consider alternative licensing options for the Class of 2020 and others slated to take the bar exam this summer, in light of restrictions in place due to the COVID-19 pandemic.

Since the launch of our Building a Better Bar project last July, IAALS has made significant headway in empirically defining the minimum competence law school students need to move on to successful practice. As of mid-February, we've held nearly 40 focus group sessions; we will wrap up all focus groups in March, and are preparing for a thorough analysis of the rich qualitative data we have gathered.

IAALS’ Court Compass project is all about incorporating user-centric design into courts’ reform process to engage and empower litigants in creating solutions and to help improve their trust and confidence in the legal system. The results of IAALS’ model workshops were just released in a new report, titled Redesigning Divorce: User-Driven Design for a Better Process.

It is no secret that divorce poses significant problems for those who go through the legal process. The adversarial nature of the legal process can put people at odds with one another and the courts are not well-positioned to provide emotional and future-planning support. IAALS has released a new report detailing the evaluation of our out-of-court model aimed at addressing these challenges for families with children.

In the past several years, design thinking has gained traction in the legal field as a method for involving litigants and other stakeholders in developing improvements to the legal system. IAALS has taken design thinking one step further in applying a structured qualitative research approach to the process.

In the last blog, we explained that the 77 foundations survey respondents identified as being necessary for new lawyers in the short term are largely consistent and definitive across respondents. Still, there were a few differences that highlight foundations some practice settings emphasize over others. Similarly, when we focused on private practice, we discovered only slight variations among different law firm sizes. In this blog, we explore the foundations that make up the whole lawyer for each private practice firm size category, and the differences as compared with one another and the whole lawyer overall.

In our previous blog, we explained that the 77 foundations survey respondents identified as being necessary for new lawyers immediately upon graduation from law school are consistent and definitive throughout the practice of law. The similarities we saw in responses across demographics, firm sizes, and practice-specific characteristics suggest that the findings can be employed with confidence by law schools, the profession, employers, and others to facilitate the development of crucial foundations needed by lawyers right out of law school. Nonetheless, there were a few notable practically significant differences that arose among the various practice settings we studied.

We are pleased to announce the results of our evaluation of the Resource Center for Separating and Divorcing Families (RCSDF)—the first manifestation of the IAALS Honoring Families Initiative’s out-of-court model for separation and divorce. 

Despite efforts by courts, communities, and bar associations around the country, there remains a serious need for tools that provide self-represented litigants with easy access to the information and resources required to appropriately navigate the court system. Technology is increasingly being leveraged in self-help solutions, and the concept of the litigant portal is at the core of this strategy.
