A proposed amendment to the South Carolina constitution purports to change the waiting period for a no-fault divorce from 365 days to 150 days. On March 7, 2013, Chief Justice Jean Hoefer Toal entered an Administrative Order recognizing the successful ad hoc use of a Fast Track jury trial process in South Carolina and implementing the voluntary process statewide. The Court also adopted Rules and Procedures for the Fast Track jury trial process, which apply in the absence of agreement of counsel otherwise.

When they return in January, South Carolina legislators will elect judges for nine new circuit and family court judgeships, providing critics of this selection process with an opportunity to press their case. Their concerns center on the judicial merit selection commission, a ten-member body appointed by legislative leaders—and including six legislators—that screens and recommends judicial candidates.

Legislators, judge debate diversity in state courts
A local chapter of the League of Women Voters hosted a forum on diversity in state courts as part of a national campaign to promote impartial courts and judicial diversity. The League made several recommendations for enhancing diversity among the state’s judges, most of whom are elected by the legislature after being vetted by a commission composed of legislators and members of the public.
