This comment was submitted to the State Bar of California in support of the proposed Paraprofessional Program, which would authorize paraprofessionals to provide legal advice in areas such as family, consumer debt, landlord/tenant, employment/income, and collateral criminal cases, as well as represent parties in court (excluding jury trials).

As America continues to navigate the COVID-19 pandemic, some lawyers are noting an increase in divorce cases. Courts should be prepared to deal with these cases as quickly and efficiently as possible—and something that could aid their efforts is technology.

IAALS submitted this comment to the Oregon State Bar Board of Governors in support of the Proposed Oregon Legal Paraprofessional Licensing Program. The program would authorize paraprofessionals to provide limited legal services—without attorney supervision—in family law and landlord-tenant matters.

Under many states’ current regulatory framework, a lawyer is the only option when it comes to addressing legal issues. Fortunately, however, a number of states are looking beyond lawyers—to limited licensed paraprofessionals, lay advocates, court navigators, and other types of allied legal professionals—in order to close the justice gap. And that number is growing.  

In October, the Indiana Supreme Court published the Family Law Taskforce's final recommendations on how to make courts more efficient, less expensive, and easier to navigate in family law matters, with an emphasis in problem-solving, triage, training and stakeholder partnerships, and technology.

Our data from the US Justice Needs project draws from more than 10,000 surveyed individuals and illuminates the contours of the justice crisis in America—revealing that, while certain groups are disproportionately impacted by justice issues, no socio-demographic group is untouched.

IAALS and HiiL have released the results of our US Justice Needs study, providing data on the justice problems Americans experience and the ways they seek to resolve them. Now that we know what people need help with most, we can begin to chart a new path forward to improve our justice system nationwide.

IAALS and HiiL have completed the first nationwide survey of its size to measure how Americans across a broad range of socio-demographic groups experience and resolve their legal problems. The full US Justice Needs report with the survey results will be released on September 1, with two live webinars presenting the data, reporting on the outcomes, and suggesting solutions.

In May, the Colorado Judicial Branch announced that a pilot program allowing documents in family court cases to be filed online will expand. Many courts in the last year have implemented or bolstered their e-filing systems in order to keep the legal system moving amidst courthouse closures during the COVID-19 pandemic.

This month, IAALS and its partners kicked off the Redesigning Legal Speaker Series with a panel exploring how judicial leadership can play a critical role in expanding access to legal services and access to justice. The panelists discussed the status of regulatory innovation, how courts and others are seeking to address the problems, and why state supreme courts and the organized bar must start forging solutions now.

In May, the National Center for Access to Justice published the latest iteration of the Justice Index, a national survey of state civil justice policies. Based on an examination of policies across four civil justice areas—attorney access, support for self-represented litigants, language access, and disability access—the index assigns a score to each state.

In May 2021, amendments to the Utah Rules of Civil Procedure went into effect, several of which provide better notice of parties’ rights and obligations at the outset and throughout a lawsuit. The rule amendments are also paired with forms that include notice of rights in plain language and in multiple languages.

In March, IAALS wrapped up our Pandemic Positives Speaker Series, bringing together a number of courts and legal service providers who, in the wake of the COVID-19 pandemic, quickly implemented new processes for providing both in-person and virtual services to ensure access to information and assistance.

The Chicago Bar Foundation has put together a new toolkit for Illinois attorneys who would like to offer unbundled legal services to potential clients with civil matters in trial court. The toolkit helps attorneys to determine whether or not a litigant is a good candidate for bundling, provides attorneys with talking points, and contains other practical materials.

The last twelve months have been an unforgettable crucible. At IAALS, we have taken a hard look at our work and what it will take to build a better legal system for everyone. Our 2020 Annual Report illustrates our ability to foster the change we need—and our capacity to do even more.

Since 2018, the Colorado Bar Association Federal Pro Se Clinic has been helping people navigate the overwhelming process of filing and pursuing a lawsuit in federal court without a lawyer. Use of the clinic has increased substantially in the time it has been in operation, and all signs point to increasing demand for pro se assistance. 

Earlier this year, Arizona began training people to give limited legal advice on civil matters stemming from domestic violence. These advocates, the first of their kind in the state, are learning to provide legal advice on topics such as protective orders, divorce, child custody, consumer protection, and housing.

Last month, IAALS kicked off our Pandemic Positives Speaker Series, bringing together a number of courts and legal service providers who, in the wake of the COVID-19 pandemic, transformed their day-to-day operations to continue serving the public throughout this critical time.

The pandemic has affected our civil justice system in many ways, yet perhaps the most important role access to justice entities can play in the near future is to advocate for the retention of remote access systems for court appearances as well as for the delivery of legal and self-help services.

2020 revealed that most of us are swimming naked when it comes to our ability to meaningfully access our justice system. 2020 certainly exacerbated issues, but its true effect and power was revealing our society’s not-so-secret dirty secrets: systemic racism, growing income inequality, the failing U.S. healthcare system, and a justice system that only serves a small minority of Americans.
