The Committee on Legal Education and Admissions Reform (CLEAR) recently released a high-profile report exploring why the legal profession is struggling to meet the needs of the majority of Americans. In this report, CLEAR points to multiple IAALS projects to support their recommendations, underscoring IAALS’ role in shaping national reform.

IAALS has launched Pathways to Legal Licensure, a landmark empirical study examining multiple approaches to attorney licensure across the United States. The project will assess how different licensure pathways measure and uphold minimum competency in the legal profession.

As we begin 2025, IAALS is poised to make our biggest gains to date as we work to bring better access to our justice system for everyone. We have laid the groundwork for innovations across many states and sectors of our system—due in large part to people like you, our partners and colleagues.

Last week, IAALS gathered with partners and friends for our 16th Annual Rebuilding Justice Award Dinner, celebrating the year’s awardees and everyone who works with us to jumpstart the groundbreaking and achievable solutions that will clear a path to justice for everyone.

In November, Oregon made history by introducing a non-exam, performance-based pathway to licensure for lawyers. By exploring alternative routes and gathering data, other states can establish rigorous, fair systems that foster competent legal professionals.

Throughout the past year, IAALS has been at the forefront of advancing justice by broadening access to legal assistance, rethinking regulation, and redefining legal licensure. As we step into 2024, we remain dedicated to bringing about transformative change within the justice system.

Oregon has pioneered a new lawyer licensing approach, allowing law school graduates to become licensed to practice law without taking the traditional bar exam. This innovative pathway to licensure was developed with insights from IAALS’ research.

The Utah Bar Admissions Working Group has proposed an inventive attorney licensure path rooted in IAALS' Building a Better Bar research. It addresses traditional bar exam shortcomings by prioritizing competence, diversity, and access to justice through five requirements for admission and continuous assessment.

In July, IAALS continued the Redesigning Legal Speaker Series with a panel delving into alternative lawyer licensing programs, how they differ from the current bar exam, what some jurisdictions are already testing, and how these alternatives might impact the profession.

A growing number of states are exploring the permanent implementation of alternative licensure approaches that would allow law school graduates to obtain their license through nontraditional avenues that run adjacent to—or bypass entirely—the bar exam.

Over the past several years, IAALS has designed resources to improve legal education and legal hiring; challenged the legal community to examine its licensure practices; and promoted a justice system that meets the demands of everyday people by clearing regulatory obstacles to innovation, development, and collaboration. And this work is just getting started.

Lawyer development is a single continuum that starts even before the first day of law school, and continues past the point when a lawyer has become an independent, confident, and proficient professional. Until we recognize this fact, we will continue to struggle to develop lawyers properly.

Over the past year, we have processed three wrenching national experiences. At IAALS, we have imagined the experiences as tests. Because we aspire to advance the American legal system, we have sought to answer these tests together—and for the sake of our shared mission.

The pandemic’s disruption to the status quo brought with it a critical view of the bar exam, how it is administered, and whether it actually tests what it purports to. The status quo—and tinkering around its edges—is not good enough. It is time we had the courage and will to look beyond the assumptions that underpin the current bar exam and towards outcomes and purpose for a new era.

In a groundbreaking report, IAALS, in partnership with Professor Deborah Merritt at The Ohio State University Moritz College of Law, has defined the minimum competence that new lawyers need to be qualified to practice law—and provides recommendations for how legal licensing processes like the bar exam must change to be more fair to bar applicants and to better protect the public.
